We are required by the Fair Credit Reporting Act to disclose how we obtain and use consumer reports as part of our applicant screening process.

📋 What is this document?

This FCRA Addendum is part of your rental application with RFPC Management LLC. It explains how we may obtain and use consumer reports — including credit checks and background checks — to evaluate your application, and what your rights are under federal law.

🔍 What reports may be obtained?

Reports may include information about your credit history, criminal records, eviction records, employment history, and rental references as permitted by the FCRA.

🔒 Does it affect my credit score?

No — we use a soft pull through TransUnion. Your credit score is not impacted by our screening process.

FCRA Addendum to Lease Application

Effective 11-28-2023. This Addendum is made and entered into between all Prospective Residents and RFPC MGT (“Landlord”) as an addendum to the Application.

1. Purpose and Consent

The prospective resident acknowledges and agrees that Landlord may obtain consumer reports and/or investigative consumer reports (collectively referred to as “Reports”) on Tenant, as permitted by the Fair Credit Reporting Act (FCRA), for the purposes of evaluating the Tenant’s creditworthiness, rental history, and suitability as a tenant.

2. Authorization and Release

Tenant hereby authorizes Landlord, its agents, and designated third-party screening agencies to obtain and use Reports for the purposes stated in Section 1. Tenant understands that the Reports may include, but are not limited to, information about Tenant’s credit history, criminal records, eviction records, employment history, and rental references. Tenant releases Landlord and any third-party screening agencies from any liability arising from the procurement or use of such Reports.

3. Information Accuracy

Tenant acknowledges that the accuracy of the information contained in the Reports is the responsibility of the reporting agencies and data furnishers. Tenant agrees to notify Landlord in writing of any inaccuracies found in the Reports.

4. Adverse Action Notice

In the event that Landlord takes any adverse action against Tenant based, in whole or in part, on information contained in the Reports, Landlord agrees to provide Tenant with an Adverse Action Notice as required by the FCRA. The Adverse Action Notice will include the name, address, and contact information of the reporting agency that provided the information.

5. Confidentiality and Data Security

Tenant acknowledges that the Reports may contain confidential and sensitive information. Landlord agrees to maintain the confidentiality and security of the Reports in accordance with applicable laws and regulations.

6. Governing Law

This Addendum shall be governed by and construed in accordance with the laws of the state in which the rental property is located.

7. Entire Addendum

This Addendum to the application is between the parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
